In today's blog, we will be discussing Tasmania’s 190 nomination criteria. It's important to note that state nomination and your visa application are two separate processes. The Tasmanian Government assesses your application for state nomination, while the Department of Home Affairs handles your visa application.
To meet the Home Affairs criteria, you must:
Achieve a points-test score of 65 or higher, including state nomination points.
Have a positive skills assessment in your nominated occupation.
Be under 45 years of age.
Meet the minimum English language requirement of competent, unless a higher level is required by your assessing authority.
Before diving into Tasmania’s 190 criteria, keep in mind the following:
Meeting the minimum nomination requirements does not guarantee you will receive a Tasmanian nomination. Only the most competitive Registrations of Interest will be selected for an invitation to apply.
Candidates nominated for a Subclass 491 Skilled Work Regional (Provisional) visa will not be eligible for future nomination for a permanent Subclass 190 Skilled Nominated visa.
Any outstanding debts to Tasmanian Government agencies, such as for education or health, must be settled or arrangements made before seeking nomination. You will not be eligible for nomination until the debt is paid or a payment plan is in place.
Tasmania’s 190 nomination involves three steps:
Expression of Interest (EOI)
Registration of Interest (ROI): Registration is free and valid for six months. If your registration expires without an invitation, you may register again.
Nomination Application
In this blog, we will explore the nomination pathways for the 190 visa.
Some key considerations before examining the pathways:
You must meet the minimum nomination requirements for your chosen pathway to register your interest and be considered for nomination.
While priority attributes are not required, they enhance your competitiveness for a limited number of nominations.
The more priority attributes you possess, the better your chances of receiving an invitation.
When you register in the Gateway, your priority status will be indicated by a Gold, Green, or Orange Pass:
Gold Pass: Immediate eligibility to apply for nomination.
Green Pass: Aim to invite you within eight weeks.
Orange Pass: May be invited within six months, depending on the volume of interest and your priority attributes. If not invited within six months, your registration will expire, and you'll need to register again.
Note: Tasmania has introduced the Orange Plus pass this year.
There are four nomination pathways for the 190 visa, each with specific requirements and priority attributes that determine your pass color. You may need to possess one or more of the Priority Attributes listed for all pathways.
The four nomination pathways are:
Tasmanian Skilled Employment Pathway
Tasmanian Skilled Graduate Pathway
Tasmanian Established Resident Pathway
Overseas Applicant (Health Sector Job Offer) Pathway
Let's begin with the first pathway:
Tasmanian Skilled Employment Pathway (TOSOL option):
Your employment must be in an occupation listed on the Tasmanian Onshore Skilled Employment Occupation List (TOSOL) and meet any caveats listed for that occupation.
You must have been working in Tasmania for six months immediately prior to your application.
Your employment must average at least 20 hours per week over the six-month period prior to lodging your application.
If you are a subcontractor, you may be considered if you have a related skills assessment and at least 12 months of business activity in Tasmania.
Long-term employment option - all occupations eligible for this pathway:
You must have been working in Tasmania in a role closely related to your skills assessment for at least 15 months immediately prior to your application.
Your employment must meet any occupational caveats listed for your occupation.
If you are a subcontractor, you may be considered if you have a related skills assessment and at least 15 months of business activity in Tasmania.
For both options:
Your employment must average at least 20 hours per week over the six-month period prior to lodging your application.
You must currently live in Tasmania and intend to continue living in Tasmania. Your dependents must not reside in another Australian state or territory.
Your employment must be closely related to your nominated occupation (a skilled role within the same ANZSCO 4-digit group as your skills assessment).
There must be a genuine, ongoing need for your position within the business, including a minimum 12-month contract with at least three months remaining at the time you apply for nomination.
Now, let's move on to the second pathway:
Tasmanian Skilled Graduate Pathway:
All occupations are eligible for this pathway.
You must have completed a course of study and obtained a letter of completion from a tertiary institution in Tasmania registered on the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS).
You must have lived in the state for at least two calendar years from the commencement of your course and for the duration of your studies.
Your course of study must be AQF 5 (Diploma) or higher, or at least Certificate III related to an ANZSCO Major Group 3 or Group 4 occupation, and be listed on CRICOS with a duration of at least 92 weeks.
Your course must have been completed full-time and on-site in Tasmania.
You must currently live in Tasmania and intend to continue living there.
Tasmanian PhD candidates who have not completed an undergraduate degree in Tasmania are eligible after living in Tasmania and completing at least two years of their PhD discipline in Tasmania.
Apart from meeting these minimum criteria, you may also need to possess one or more of the Priority Attributes listed for this pathway.
The third nomination pathway is the Tasmanian Established Resident Pathway
To meet the requirements for this pathway:
You must have been living in Tasmania for at least three years (with no more than 50% of your total Australian residence period spent in another Australian state or territory), and one of the following:
Currently be employed in Tasmania in a role equivalent to ANZSCO Skill Levels 1-3, including a cumulative 12 out of the last 24 months, with a minimum average of 20 hours per week.
Currently be employed in Tasmania, including a cumulative 18 months in the last 3 years, in a role equivalent to ANZSCO Skill Level 4 or 5, with a minimum average of 20 hours per week.
Have operated a business for at least the last two years with taxable earnings equivalent to the Temporary Skilled Migration Income Threshold (currently $73,150).
Apart from meeting these minimum criteria, you may also need to possess one or more of the Priority Attributes listed for this pathway.
The fourth and final nomination pathway for the Subclass 190 is the Overseas Applicant (Health Sector Job Offer) Pathway. Only health occupations are eligible for this pathway, and the occupation list is available on Migration Tasmania’s website.
To be considered for this pathway, you must meet all the following criteria:
Minimum Requirements:
You must have a health or allied health skills assessment for an occupation within one of the 4-digit ANZSCO groups listed.
You must have received a formal job offer for a position based in Tasmania that is closely related to your nominated occupation.
You or any dependents must not have lived in another Australian state or territory within the last 12 months.
Your employer must have a well-established business that has been actively operating in Tasmania for at least the past 12 months.
Your wages and conditions must be no less favorable than those that would apply to an Australian citizen or permanent resident, and your salary must be at least equivalent to the local market rate.
There must be a genuine and ongoing need for your position within the business, with the capacity for the business to sustain your employment.
