What is a 408 Visa? It's a temporary visa that lets you stay in Australia to work if you are employed or have an offer of employment in a key sector or any other sector of the economy. This visa is granted for up to 12 months if you're working in the key sectors of Agriculture, Food processing, Healthcare, HTA, Disability care, Childcare, and Tourism and Hospitality, or it can be granted up to six months if you're working in any other sector. Since the Department has removed the requirement for the health assessment for this visa, we have noticed a very quick and automatic grant for the 408 visas. And some have been granted within minutes of lodgements. Another thing we have noticed is that all recent 408 visa grants are for 12 months, even when a client was not working in a critical sector.

Here are some frequently asked questions about the 408 COVID Pandemic Stream Visa we have been hearing.

  1. Can you include family members in your COVID-19 pandemic event visa application? The primary and secondary applicants must be in Australia at the time of application and decision. You can include members of the family unit who are in Australia with you in your application when you apply or make a subsequent entrant application; any may count in adding family members who are in Australia. You can do this after you lodge your application. Family members who apply with you must also meet health and character requirements.

  2. What to do if you have lost your application but a bridging visa has not been granted yet? If you were in Australia when you applied for this visa, you might be granted a bridging Visa A-BVA if you held a substantive visa when you applied. You could be granted a bridging Visa C if you did not hold a substantive visa when you applied. It may take up to five days for your bridging visa to be granted. Your bridging visa will come into effect from the date it is assessed to maintain your lawful status in Australia while your temporary activity pandemic event visa application is being assessed.

  3. Can you change your employer while holding the 408 COVID visas? Department has advised that due to the need for workers in Australia, they have temporarily implemented a less restrictive policy on visa condition 8107, a work limitation for COVID-19 pandemic events visa holders. As such, your current employer may not align with the proposal on your visa grant notification after the grant of your COVID visa. To work in a key or any other sector, you may change employment as long as you stay employed in a key sector. If you're working in a key sector, work for more than one employer as long as your primary employment is in a key sector if you're working in a key sector. If we have granted you a COVID-19 Pandemic Event Visa to work in Australia, you should continue to work while you have your visa. However, you do not need to notify the Department of any of the above changes.

  4. Can you change your employer's while awaiting the outcome of your COVID-19 pandemic event visa? If you have applied for this visa to work in a key or any other sector, you may change employment as long as you stay employed in a key sector. If you're working in the key sector, work for more than one employer as long as your primary employment is in a key sector if you are working in a key sector.

  5. Can I travel while holding your COVID-19 pandemic event visa? Yes, you can travel outside Australia and return multiple times as long as your COVID-19 pandemic event visa is in effect and you meet any travel requirements in place at the time you travel.

  6. What if your current subclass was the right event visa is about to expire? Can you get this visa again? If you currently hold a COVID visa that is about to expire, you may be eligible for another COVID 408 visa if you wish to remain in Australia to continue working in an Australian sector.

  7. Can I travel overseas while awaiting the outcome of the COVID 19 pandemic event visa application? You must be in Australia both at the time of application and decision. If you submit an application and leave Australia before Department decides on it, make sure you hold a visa that allows you to return to Australia. Now we do not recommend traveling while you're waiting for the decision on your COVID visa.
